Safety Camera PartnershipsPurpose

1. 

To inform members about the future funding of  the Scottish Safety Camera Partnerships when hypothecation ends on 31st March 2007 and to seek comment on the proposed way forward on the development of the Partnerships.
RecommendationsMembers are invited to:

      i.               Provide comments on the issues set out in this report; and

      ii.               Approve COSLA’s position as outlined in paragraphs 11 and 12.

Background

2. 

The Scottish Safety Camera Programme aims to reduce the number of people killed or seriously injured on Scotland's roads through the targeted deployment of safety cameras (fixed and mobile speed and “red light” cameras).

3.            

The Programme is delivered by partnerships consisting principally of local authorities and Police.  Other partners can include the trunk roads network, district courts and other agencies with an interest in reducing road casualties, e.g. NHS, Fire and Rescue Services and the Ambulance Service.  There are currently eight Partnerships in Scotland: Central Scotland, Dumfries & Galloway, Fife, Lothian & Borders, North East, Northern, Strathclyde, and Tayside.

4.            

The framework within which Partnerships must operate includes:
·    sites for camera enforcement must target areas in greatest need of speed and casualty reduction and must comply with visibility and conspicuity criteria - to ensure that motorists know where cameras are located;
·    strict cost recovery and financial processes to ensure that the only incentive for participating in the programme is to reduce casualties;
·    submission of quarterly monitoring data and accounts and an operational case to the Scottish Executive Scottish Programme Office for approval by the Scottish Advisory Board, of which COSLA is a member.

5.            

The Safety Camera Programme is funded under hypothecation, an agreement with HM Treasury which allows fine revenue raised from speeding offences to be recovered to fund camera enforcement.  Currently, partnerships are funded on a "cost recovery" basis, allowing them to recover the costs of safety camera activity from fine revenue to fund equipment costs, enforcement and processing costs, as well as communication costs for public information campaigns aimed at changing driver behaviour.

Development

6.            

As of 1st April 2007 hypothecation funding will change to a grant-funded programme based on 3-year operational plan.  The ending of hypothecation has provided the Scottish Executive with an opportunity to revise the current operation and focus of Safety Camera Partnerships and to bring the programme under the control of Scottish Ministers who approved the following recommendations:
·     all Safety Camera Partnerships will continue under their current structure, with East Lothian and Midlothian Councils invited to join the Programme.

·     Partnerships will be required to produce, on an annual basis, a comprehensive, rolling three-year Operational Programme and funding will be allocated on a 3 year basis.

·       the Programme Office will be retained with overall responsibility for monitoring, funding and performance of the Partnerships. Key Performance Indicators will be developed to measure performance.

·      a revised Handbook of Rules and Guidance is to be developed that will reflect the changes to the Safety Camera Programme.

7.            

 These new arrangement will come into place on 1st April 2008, allowing Safety Camera Partnerships to make the transition to these arrangements during 2007.

Issues arising from the new arrangements

8.            

There are a number of issues that need to be clarified by the national Programme Office. A particular concern is the opportunity for centralised, national control of the programme to be imposed on local partnerships.   For example, there is no flexibility in either the Handbook or proposed funding that would enable a local partnership to work in collaboration with the community in relation to the positioning of safety cameras.

There is a danger here that  local government’s role will be merely to implement the Programme as determined strategically by the Scottish Safety Camera Programme Office. This control has the potential to work against the changes local government is committed to implementing through the public sector reform agenda, specifically around ensuring locally delivered services are locally accountable.

10.        

Other concerns include the need for:

·                guaranteed and adequate funding; 

·                a balance between local and national priorities with regard to positioning safety cameras;

·                an open and transparent consultation process in relation to the revised Handbook of Rules and Guidance and development of key performance indicators.

COSLA Approach

11.        

It is proposed that COSLA lobbies for adequate funding for Partnerships; clear and transparent consultation processes for the development of performance indicators and the Handbook of Rules of Guidance and, most importantly, the need for a balance of local and national priorities in reducing road traffic accidents.

12.        

It is therefore recommended that members remit COSLA officers to consult on the above issues with a wider group, including Directors of Finance and SCOTS, and to negotiate with the Scottish Executive to ensure all Partnerships’ costs are fully met and that the Programme is developed in full partnership with local government and reflecting the need for local responsiveness and local accountability. 

Conclusion

 Local government has a key leadership and co-ordination role in improving road safety and in reducing road traffic accidents, both issues of high concern to communities.  It is crucial, therefore, that local government has an equal role in the development of the safety camera programme to ensure that there is a balance of both local and national priorities.
